You could make a "legally it’s rape" argument for Angel, but who cares, since it was consensual and California laws aren’t going to apply to the non-human Angel. Spike pushed Buffy down, she pushed him off before he got anywhere near raping her. And then he immediately stopped trying, and it was over. We get the idea that both Spike and Angel committed rapes while they were soulless, so I don’t think either one of them is going to win a prize for their soulless behavior in this regard.
